Sarah Maguire was my wifes 3x great grandmother,born in Dublin in 1860,married in Chorlton on Medlock,Manchester in 1889 to George Edward Tolley.Aged 3,Sarah and her two sisters were pawns in a custody battle of some repute,attracting much interest and comment in the national press in November 1863.Essentially,her parents,Micheal and Jane Maguire,(nee Lambert)were in a mixed marriage.On his death bed,MIcheal signed a will requesting that his children become under the guardianship of three individuals who were tasked with ensuring they followed Catholic upbringing,against the wishes of their Protestant mother.This signed document was allegedly required by the Catholic priest,Fr.Keon,prior to the provision of absolution.An initial hearing in Naas was relocated to a higher court in Dublin,but the jury were unable to reach a unanimous verdict and were discharged.This went on into 1864,when various notable politicians and Catholic clergy,were reported to be forming a committeee to defend Fr.Keon and significant fundraising ensued.

However,I can find no result of the case which I believe would have much affected Sarah and her sisters.In her evidence,Jane indicated that she had placed her children in the hands of a Protestant group in Newcastle,but i cannot find anything more in that regard.Jane went on to remarry in 1869 in Liverpool,but their is no inkling of the girls...Her second husband ,William Rodgers,was a sailor,recorded on the 1871 census on board a vessel at North Shields,while Jane and an infant daughter were living in Ramsgate,Kent.

Sarah was married in 1889,in the parish of her aunt,Margaret Gage(nee Lambert),her sister Emily was a witness and the ceremony was probably attended by her step sister,Madeline Lambert Rodgers.Where she was from 1864 until then remains a mystery,but the result of the court case and custody is perhaps central...

  • A couple usually married in the bride's church. Because Sarah married in the parish of her aunt Gage in Manchester, it is very possible Sarah lived with her aunt.  If you've exhausted the search for Sarah Maguire in the relevant years, perhaps search for Sarah Gage? Just an idea. Good luck.

    Margaret and John Gage married in Dublin where he was a soldier.In 1871,they were based on Jersey before being deployed in Canada in the mid 1870s,to deal with a Fenian incursion.John and Margaret were recorded living in Chorlton on the 1881 census,where he was a publican.John was a witness at Sarah's wedding so evidently there remained quite close ties.However,as a child,Sarah would not have been living with the Gages,due to their army deployments.It is entirely possible that Sarah did live with or near the Gages,but not until after the 1881 Census.

    The results after the custody case are ,I believe,quite key to Sarah's wherabouts....
